高捷活春宮有遮外套　獲不起訴

【綜合報導】今年4月一對年輕男女在高捷車廂上演活春宮，被香港遊客錄影po網，多國瘋傳。影片中女高中生以外套蓋頭趴在一名男大生大腿間，男大生表情陶醉，事後兩人坦承口交被依妨害風化罪移送，但高雄地檢署認為男大生罹患亞斯伯格症（自閉症），無法克制性衝動才要求口交，並以外套遮蓋無意讓人觀賞，昨將兩人不起訴。

檢方指此段影片全程以外套蓋住，林女的肢體動作僅隱約起伏，並非十分明顯，而外套差點滑落時，黃男也緊張拉起，認為兩人無猥褻犯意，將兩人不起訴。 至於兩人是否會被依《社會秩序維護法》裁罰，前鎮分局表示，本案當初用妨害風化罪嫌移送，不起訴後，警方也不會再以行政法裁罰當事人。
