涉帶威盛機密 祥碩4員工遭訴

IC設計廠威盛公司日前控告華碩旗下記憶體控制晶片廠祥碩科技員工等涉嫌違反著作權法等。北檢今天偵結，起訴4名祥碩員工。

辦案人員指出，威盛公司控告祥碩採用USB 3.0（Universal Serial Bus3.0，第3代通用序列匯流排）等晶片技術侵犯其中的PHY（實體層）智財權技術，提出違反著作權法的告訴。

檢方表示，威盛公司懷疑並控告是3名離職的設計研發部工程師林書宇、黃永中、蔡乙仲，把相關有著作權的晶片技術（商業機密）帶到跳槽的祥碩公司。

台北地檢署在4月16日對祥碩公司發動搜索，查扣與威盛公司電路結構高度相似的電路圖等。

北檢今天認定林書宇、黃永中、蔡乙仲及祥碩研發處電路設計部協理張棋等4人為共犯，均違反著作權法、背信及洩漏商業機密等罪，將4人起訴，並對祥碩公司科以罰金刑。
