ECFA公投案 黃昆輝行政訴訟敗訴

台聯黨主席黃昆輝兩年前提出ECFA公投案遭中選會駁回所以提告。台北高等行政法院審理後，認為全案不符合公投要件，今天判黃昆輝敗訴，全案還可上訴最高行政法院。

黃昆輝在民國99年4月間，以「你是否同意政府與中國簽訂ECFA？」為題，帶著十萬人連署書向中選會提出公投案，中選會將提案送交公投審議委員會審議，結果公審會以人民提出的公投案「必須持改變現狀立場」才符合「公投法」制度設計，駁回台聯的提案。黃昆輝不滿提行政訴訟。

台北高等行政法院認為，公投是在徵求公民意見，並不是公投法所訂定的重大政策複決，黃昆輝的提案主文和理念不合，中選會駁回公投提案並沒有不法，所以判決黃昆輝敗訴。
